ในปัจจุบัน ที่พักอาศัยมีมากมายหลายประเภท นอกเหนือจากบ้านเป็นหลังๆ หรือบ้านในโครงการแล้ว ยังมีที่พักอาศัยประเภทอื่นๆ ซึ่งถือเป็นที่พักอาศัยที่ได้รับความนิยมอย่างมาก ได้แก่ คอนโดมิเนียม ห้องพัก ห้องเช่า อพาร์ทเม้นท์ เป็นต้น เนื่องจากสิ่งอำนวยความสะดวกพร้อม มักตั้งอยู่ในทำเลที่ดี เดินทางสะดวก ใกล้รถไฟฟ้า BTS , รถไฟฟ้าใต้ดิน MRT มีรูปแบบหลากหลายให้ผู้คนได้เลือกสรร มีทั้งให้เช่าแบบรายวัน เช่าแบบรายเดือน หรือแม้กระทั้งทำการซื้อขายเป็นเจ้าของได้ แต่ด้วยชื่อเรียกที่แตกแต่งกัน นำพาซึ่งความสับสนและแยกไม่ออกว่า คอนโดมิเนียม ห้องพัก ห้องเช่า อพาร์ทเม้นท์ ที่พักอาศัยแต่ละประเภทนี้มีความแตกต่างกันอย่างไร เราสามารถทำความเข้าใจแบบง่ายๆ ได้ดังนี้

1.คอนโดมิเนียม (Condominium) – คือ ตึกหรืออาคารที่สร้างขึ้นมาเพื่อเป็นที่พักอาศัยเป็นห้องๆ และสามารถแบ่งถือกรรมสิทธิ์ออกเป็นส่วนๆได้ หรือพูดได้ว่ามีการซื้อขายเป็นเจ้าของห้องพักภายในอาคารได้โดยสมบูรณ์ เสมือนบ้านหลังหนึ่ง แต่เป็นบ้านที่อยู่บนตึกสูง นั่นเอง
2. อพาร์ทเม้นท์ (Apartment) – คือ ตึกหรืออาคารที่พักอาศัย ที่เจ้าของอพาร์ทเม้นท์เป็นผู้ถือกรรมสิทธิ์ทั้งอาคาร ส่วนผู้อาศัยมีสิทธิ์เพียงแค่เช่าพักเท่านั้น โดยผู้เช่าอาศัยต้องปฏิบัติตามกฏระเบียบที่อพาร์ทเม้นท์กำหนดไว้ อพาร์ทเม้นท์บางแห่งจะมีการกำหนดระยะเวลาในการเข้าพักที่แน่นอน บางอพาร์ทเม้นท์จะเปิดให้บริการทั้งแบบรายวัน และรายเดือน
3. หอพัก (Dormitory) – สถานที่ หรือที่พักอาศัยให้เช่าที่มิได้ดำเนินการโดยสถานศึกษา ซึ่งมีนักศึกษาอายุไม่เกิน 25 ปี และระดับการศึกษาไม่เกินปริญญาตรี เช่าพักอาศัยตั้งแต่ คอนโดใกล้ฉัน 5 คนขึ้นไป โดยส่วนใหญ่หอพักจะมีขนาดเล็ก และราคาที่ถูกกว่าอพาร์ทเม้นท์

ความแตกต่างระหว่าง คอนโด และ อพาร์ทเม้นท์


ความแตกต่างระหว่าง คอนโด และ อพาร์ทเม้นท์ ในประเทศไทยที่เห็นชัดเจนที่สุดในแง่ของกฎหมาย คือ

คอนโด เป็นทรัพย์ที่ได้รับอนุญาตและจดทะเบียนภายใต้พระราชบัญญัติอาคารชุด สำหรับ อพาร์ทเม้นท์ เป็นสิทธิ์การเช่าถือครองอสังหาริมทรัพย์ในระยะยาว หรือ Leasehold มีความหมายเดียวกับคำว่า “เซ้ง”

ในมุมมองของคนทั่วไป คอนโด และ อพาร์ทเม้นท์ ดูเหมือนจะไม่มีความแตกต่างกัน แต่เมื่อถึงขั้นตอนของการซื้อเพื่อเป็นเจ้าของ จะมีความแตกต่างกันอย่างมาก

คอนโด และ อพาร์ทเม้นท์ ในแง่ของความเป็นเจ้าของ
หากคุณซื้อ คอนโด ซึ่งมีการจดทะเบียนและได้รับใบอนุญาตจากกรมที่ดิน คุณสามารถเป็นเจ้าของคอนโดแต่ละยูนิตทันที

สำหรับ อพาร์ทเม้นท์ ซึ่งไม่ได้สร้างขึ้นตามพระราชบัญญัติอาคารชุด จะไม่สามารถมอบสิทธิความเป็นเจ้าของอย่างเต็มรูปแบบ ทั้งนี้เพราะผู้พัฒนาโครงการซึ่งสร้างอพาร์ทเม้นท์ สามารถให้สิทธิ “การครอบครอง” แต่ละยูนิตภายใต้ข้อกำหนดและเงื่อนไขโดยเจ้าของโครงการ

คอนโด ซึ่งได้รับอนุญาตจากกรมที่ดิน จะมอบความเป็นเจ้าของแต่ละยูนิดกับผู้ซื้อ สำหรับพื้นที่ส่วนกลาง เช่น ระเบียง บันใด และการดูแลรักษาตึก เจ้าของคอนโดแต่ละยูนิตเป็นเจ้าของร่วมกัน และทุกคนต้องร่วมกันบริหารจัดการ

สำหรับผู้ที่มีแนวโน้มจะเป็นผู้ซื้อ คอนโด ต้องแน่ใจว่าได้ตรวจสอบชัดเจนว่า เป็นการซื้ออสังหาริมทรัพย์ที่แท้จริง ไม่อย่างนั้นมันอาจเป็นแค่ “สัญญาเช่า”

ตามพระราชบัญญัติอาคารชุด เจ้าของคอนโดจะได้รับโฉนดที่ดินซึ่งพวกเขาอาจขายหรือโอนให้ผู้อื่นตามที่เห็นสมควร เมื่อทรัพย์ได้จดทะเบียนภายใต้พระราชบัญญัติอาคารชุด ลูกค้าจะไม่ได้รับความคุ้มครองมากนัก เพราะการกำกับดูแลอาคารเป็นการดูแลจัดการโดยเจ้าของทุกคน

ในกรณีที่คุณจ่ายเงินค่า อพาร์ทเม้นท์ คุณมีฐานะเป็น “ผู้เช่า” จะไม่มีส่วนในความเป็นเจ้าของพื้นที่ใดๆภายในอาคาร ทั้งนี้ไม่ว่าจะเป็นแต่ละยูนิตหรือพื้นที่ส่วนกลาง การบริหารจัดการอาคารและสถานที่จะต้องดำเนินการโดยเจ้าของ ส่วนผู้เช่าต้องปฏิบัติตามกฎระเบียบต่างๆที่เจ้าของอาคารอาจมีข้อกำหนดเอาไว้ ทรัพย์ที่ไม่ได้จดทะเบียนภายใต้พระราชบัญญัติอาคารชุด จะต้องเสียภาษีที่อยู่อาศัยและที่ดิน

ในกรณีที่เป็นการขายสิทธิ์ โอนสิทธิการเช่า หรือ การเซ้ง การครอบครองทรัพย์สินที่เช่านั้น มีจำกัดไว้สูงสุด 30 ปี ถ้าหมดสัญญาเช่าแล้วสามารถต่อได้อีก แต่ไม่เกิน 30 ปี

เหตุผลที่คอนโดได้รับความนิยมสำหรับผู้ซื้อ เพราะผู้ซื้อสามารถเปลี่ยนแปลงทรัพย์ตามที่คิดว่าเหมาะสมในยูนิตของตัวเองซึ่งเป็นเจ้าของแบบเฉพาะเจาะจง แต่ในส่วนของตึกที่เป็นเจ้าของร่วมกันหลายคนจะไม่ได้รับอนุญาติให้ปรับเปลี่ยนอะไร ผู้ที่เป็นเจ้าของร่วมทุกคน จะต้องร่วมกันจ่ายค่าดูแลรักษาคอนโดที่เกิดขึ้นร่วมกัน เช่น การเก็บขยะ การทำความสะอาดสระว่ายน้ำ ดูแลรักษาห้องซาวน่าและสปา ดูแลห้องยิมให้อยู่ในสภาพดี และรวมถึงสิ่งอำนวยความสะดวกอื่นๆที่มีอยู่ภายในคอมเพล็กซ์ซึ่งต้องได้รับการจัดการร่วมกันโดยเจ้าของ

สมาชิกซึ่งเป็นเจ้าของคอนโดจะมีการประชุมร่วมกันเพื่อปรึกษาเรื่องระยะเวลาและรายละเอียดเกี่ยวกับงานต่างๆที่มีอยู่ โดยเฉพาะอย่างยิ่งเกี่ยวกับเวลาที่ต้องทำการซ่อมแซม หรือวิธีการทิ้งขยะ การประชุมร่วมกันเป็นสิ่งที่ต้องทำสำหรับเจ้าของคอนโดเพื่อจะได้รู้จักกันดีขึ้น เพราะสุดท้ายแล้วพวกเขาต้องอยู่ร่วมกันในคอมเพล็กซ์ สิ่งที่เกิดขึ้นเมื่อมีคนซื้อคอนโด พวกเขามีส่วนเป็นเจ้าของบางส่วนในตึกนั้น นั่นทำให้เห็นถึงความเป็นเจ้าของที่แท้จริง ไม่ต่างจากการมีส่วนเป็นเจ้าของบริษัทแห่งหนึ่งเมื่อมีการลงทุนซื้อหุ้นในบริษัทนั้น คำว่า Condominium เป็นภาษาลาติน ซึ่งมีความหมายว่า การเป็นเจ้าของร่วมกัน

ความเป็นเจ้าของ ยังขึ้นอยู่กับแนวทางที่ใช้ลบล้างของคอนโดและอพาร์ทเม้นท์ ในขณะที่พื้นฐานที่สามารถทำ และไม่สามมารถทำ จะเหมือนกันเป็นส่วนใหญ่ ในทางปฏิบัติและการดำเนินการตามกฎยังมีความผันผวนอยู่

ยูนิตในอพาร์ทเมนต์คอมเพล็กซ์มีคุณสมบัติมาตรฐานที่เหมือนกันทั่วทั้งอพาร์ทเม้นท์ บางครั้งอาจมีแผนผังชั้นที่แตกต่างกันและมีตัวเลือกสำหรับอุปกรณ์มาตรฐานหรือการอัพเกรด หากเจ้าของทรัพย์กำลังลงทุนปรับปรุงภายในยูนิต

สิ่งอำนวยความสะดวกในอพาร์ทเมนท์ของอาคาร อาจรวมถึงสิ่งต่อไปนี้:

สิ่งอำนวยความสะดวกใดๆที่ทำให้ทรัพย์ดูน่าสนใจยิ่งขึ้นในประเภทนี้ อาจเป็นสิ่งที่ทำให้อาคารอพาร์ตเมนต์โดดเด่น โดยเฉพาะอย่างยิ่งในอพาร์ทเมนต์คอมเพล็กซ์ที่ใหม่กว่า ยิ่งอพาร์ทเมนต์หรูหรามากเท่าไหร่ ก็ยิ่งมีช่องว่างที่หลากหลายมากขึ้นเท่านั้น

สิ่งอำนวยความสะดวกในชุมชนของคอนโด ค่อนข้างเหมือนกับสิ่งที่คุณจะพบในอพาร์ทเมนต์คอมเพล็กซ์ ภายในยูนิตเป็นที่ที่สิ่งที่จะเห็นความแตกต่างได้มากที่สุด คุณสมบัติต่อไปนี้ บางครั้งมีเอกลักษณ์และเพิ่มระดับความหรูหรามากขึ้น เช่นเคาน์เตอร์หินแกรนิต พื้นไม้เนื้อแข็ง และเพดานโค้ง

โฉนดคอนโด

โควต้าชาวต่างชาติ (49%)
ชาวต่างชาติทุกสัญชาติสามารถมีสิทธิ์ได้เป็นเจ้าของคอนโด เขา/เธอสามารถซื้อคอนโดได้หากสามารถขายคอนโดได้ภายใต้โควต้าชาวต่างชาติ มีกฎหมายที่สามารถขายพื้นที่ห้องชุดได้เพียง 49% ของพื้นที่ทั้งหมด โดยอย่างน้อย 51% ของพื้นที่คอนโดต้องจดทะเบียนภายใต้เจ้าของที่มีสัญชาติไทย

เมื่อซื้อคอนโดมือสอง ผู้ขายจะต้องได้รับจดหมายที่ออกโดยนิติบุคคลอาคารชุดซึ่งระบุว่าห้องชุดอยู่ในโควต้า 49% ของอาคารคอนโด ผู้ขายจะต้องได้รับจดหมายจากนิติบุคคลว่าได้ชำระค่าบำรุงรักษาอาคารครบถ้วนแล้ว

พระราชบัญญัติอาคารชุด
กฎหมายทรัพย์สินในประเทศไทย - อาคารที่อยู่อาศัยที่จดทะเบียนในประเทศไทยมี 2 ประเภท ได้แก่ คอนโดที่จดทะเบียนภายใต้พระราชบัญญัติอาคารชุดโดยมีใบอนุญาตอาคารชุด และอาคารอพาร์ตเมนต์ที่ไม่ได้จดทะเบียนภายใต้พระราชบัญญัติอาคารชุด

เฉพาะคอนโดที่จดทะเบียนเท่านั้นที่สามารถเสนอกรรมสิทธิ์ส่วนบุคคลได้เต็มรูปแบบ โดยมีโฉนดที่ออกโดยรัฐบาล พระราชบัญญัติอาคารชุดระบุตัวอย่างขั้นตอน และข้อกำหนดสำหรับอาคารอพาร์ตเมนต์หลายยูนิตที่จะได้รับใบอนุญาตเป็นคอนโด พระราชบัญญัติอาคารชุดฉบับล่าสุดผ่านการออกกฎหมายในปี 2551

กฎหมายใหม่สำหรับทรัพย์สิน "ผู้ประกอบธุรกิจ"
ภายใต้กฎหมายใหม่การเช่าที่อยู่อาศัยตั้งแต่ 5 ยูนิตขึ้นไป จะถูกจัดประเภทอย่างเป็นทางการว่าเป็น “ธุรกิจที่ควบคุมตามสัญญา” และเจ้าของทรัพย์สินจะถูกจัดประเภทเป็น “ผู้ประกอบธุรกิจ”

กฎหมายใหม่นี้ มีขึ้นเพื่อให้การคุ้มครองผู้บริโภคมากขึ้นจากสัญญาเช่าและผู้ให้เช่า กฎระเบียบใหม่จะบังคับใช้ เพื่อให้แน่ใจว่าผู้เช่าจะไม่เสียเปรียบอย่างไร้เหตุผลจากข้อตกลงการเช่าที่ไม่เป็นธรรม

กฎหมายใหม่กำหนดผู้ประกอบธุรกิจให้เช่าที่อยู่อาศัย เป็น:

“ผู้ประกอบธุรกิจที่ให้เช่าอสังหาริมทรัพย์อย่างน้อยห้ายูนิตขึ้นไปในอาคารหนึ่งหลังขึ้นไปเพื่อใช้ในที่พักอาศัย ประเภทอสังหาริมทรัพย์รวมถึง คอนโดมิเนียม อพาร์ทเม้นท์ บ้าน และทรัพย์สินประเภทอื่นๆที่ใช้สำหรับการเช่าสำหรับอยู่อาศัย (ไม่รวมโรงแรม)”

มีการเปลี่ยนแปลงหลัก 3 ประการในกฎหมายนี้:

1. ผู้ให้เช่า (เจ้าของบ้าน - เจ้าของทรัพย์สิน) สามารถขอเงินประกัน 1 เดือนและค่าเช่าล่วงหน้า 1 เดือนเท่านั้น

แนวทางปฏิบัติทั่วไปในการเช่าในประเทศไทยสำหรับผู้ให้เช่า (เจ้าของบ้าน - เจ้าของทรัพย์สิน) สามารถขอค่าเช่าล่วงหน้า 1 เดือน และเงินประกัน 2 หรือ 3 เดือน
